TERMS-NET CASH, C.O.D. orders to be accompanied by a 25% down payment. For those with credit established with us, any account due over 30 days shall be subject to a service charge of 1½% per month (18% annually) plus any cost of collection.

CREDIT SALES:
A.   Credit Sales will be allowed under the following conditions:
       1.  Prospective purchaser fills out our credit application.
       2.  Application must be approved by our credit department.
       3.  Limit or credit will be established by our credit department.
B.   At the end of each month all charges will be totaled and a statement will be sent to the purchaser. Payment in full is due by the 10th day following the month of purchase.

TAXES CHARGED:
A.   All customers will be charged sales tax unless:
       1.  Purchaser has tax identification number and merchandise is to be resold.
       2. We deliver merchandise out of state. (We must also have tax identification number.)

CLAIMS- All claims must be made with 5 (five) days of receipt of shipment or they will be disallowed. All unsatisfactory goods must be held for our inspection. Any claims will receive our prompt attention and should any adjustment need to be made, it will be done in a prompt manner. There are no guarantees whatsoever, except warranties outlined below.

SHIPPING- Should you have a preferred method or time of shipment, please notify us at the time of your order. Otherwise, we will use our best judgment. Transportation charges are to be paid by the customer and are payable upon delivery. Should you need transportation arranged, we have contacts with local independent haulers. Prices for hauling vary and are not under our control. All shipments are at purchaser's risk. Our responsibility for all materials ends with delivery to the carrier. Customers are responsible for unloading trucks.

EXPRESS WARRANTY & NON-LIABILITY- We warranty all plants materials to be true to name. No other warranty, expressed or implied, as to life, age, description, productiveness, or any other matter is hereby offered. All orders are accepted subject to weather, error in count, fire and labor shortages, and we shall not be responsible for situations beyond our control that prevent our performance. Should any stock, prove not true or name, it is agreed by both buyer and seller, that replacement of stock, or refund of original price paid for those plants, shall be the limit of the seller's responsibility. Athens Wholesale Nursery will not be liable under any circumstances for any amount greater than the original F.O.B. cost of the stock purchased.
